Attorney Michael Franklin represented in Worcester District Court a man charged with OUI. The client had .084 BAC (blood alcohol content) by taking the breathalyzer test and admitted to drinking and smoking marijuana but the government was not allowed to get the BAC into evidence because they did not have the proper documentation certifying that the breathalyzer was tested and operating correctly. Further, the police officer claimed my client failed the field sobriety tests but there was little to no evidence of impaired operation by my client.
Result: Client was found not guilty on both counts.
